Thank you for choosing Boating Sd for your boating needs. Before you proceed with renting or purchasing a boat from us, please take a moment to review the following disclaimer. By engaging in any transactions with Boating Sd, you acknowledge and agree to the terms outlined below.

Boat Rental Disclaimer:

  1. Rental Agreement: All renters must sign a comprehensive rental agreement before taking possession of the boat. This agreement outlines the terms and conditions of the rental, including responsibilities, liabilities, and safety guidelines.
  2. Safety First: We prioritize the safety of our customers. It is imperative that renters adhere to all safety instructions provided during the orientation. We recommend that all occupants wear life jackets at all times, and no boat should be operated under the influence of alcohol or drugs.
  3. Weather Conditions: Boating Sd reserves the right to cancel or reschedule reservations in the event of adverse weather conditions or any other circumstances that may jeopardize the safety of the renters. No refunds will be provided for cancellations due to weather conditions beyond our control.
  4. Insurance: Renters are responsible for any damage to the boat caused by their negligence or misuse. We offer optional insurance coverage to mitigate repair costs, and it is highly recommended for added protection.
  5. Boat Inspection: Before accepting possession of the boat, renters are encouraged to thoroughly inspect the vessel for any pre-existing damage and report it to Boating Sd. Failure to report pre-existing damage may result in the assumption of responsibility for repairs.
  6. Security Deposit: A security deposit may be required for boat rentals. This deposit will be refunded upon the return of the boat in the same condition it was rented, subject to any necessary deductions for damages or violations of the rental agreement.

Boat Sales Disclaimer:

  1. Inspection: Prior to completing a purchase, buyers are encouraged to inspect the boat thoroughly. Boating Sd provides information about the condition of the boat to the best of our knowledge, but it is the buyer's responsibility to verify its suitability for their needs.
  2. Warranty: Unless explicitly stated in the sales agreement, boats are sold "as-is" without any warranties, either expressed or implied. Buyers are responsible for conducting due diligence and seeking independent inspections if desired.
  3. Title and Registration: Boating Sd will ensure the proper transfer of title and assist with the necessary documentation for registration. However, buyers are responsible for complying with local regulations and completing any additional paperwork required.
  4. Payment Terms: Buyers must adhere to the agreed-upon payment terms outlined in the sales agreement. Failure to fulfill payment obligations may result in legal action to recover the outstanding amount.

By engaging in any transactions with Boating Sd, you acknowledge that you have read, understood, and agree to the terms outlined in this disclaimer. Boating Sd reserves the right to update or modify these terms at any time without prior notice.
